[PF:146568] Our Duty Towards Prisoners-Important!



Bismillaah, wal-hamdulilaah, was-salaatu was-salaamu 'alaa rasoolillaah,
Assalaamu alaykum wa rahmatuallahi wa barakatuhu
 
 The Prophet Muhammad [s] said: "No man forsakes a Muslim when his rights are being violated or his honour is being belittled except that Allah will forsake him at a place in which he would love to have His help. And no man helps a Muslim at a time when his honour is being belittled or his rights violated except that Allah will help him at a place in which he loves to have His help".
 
 The Prophet [s] said: "Feed the hungry, visit the sick, and free the prisoner." And he [s] said: "It is upon the Muslim faithful to free their prisoners and to pay their ransom."
And they give food, in spite of their love for it, to the poor, the orphan, and the captive (saying): "We feed you seeking Allah's Face only. We wish for no reward, nor thanks from you." (76:8-9)

 
Imaam An-Nawawi said:
If the enemy captures a Muslim or two, then is it equivalent to invading a Muslim land? There are two opinions on this. The first opinion is no, because the troubling of one Muslim soldier is insignificant. The more correct and other opinion of the two is yes, because the sanctity of a single Muslim is greater than the sanctity of an entire state. Therefore, if the Islamic State is close to the location where the prisoner was captured, then it should release the prisoner and exact a fine from those who have captured him.

Imaam Al-Qurtubi said:
Our scholars have said that ransoming the prisoners with money is waajib (obligatory), even if one dirham does not remain in the Islamic Treasury. Ibn Khuwaiz Mindaad has confirmed the existence of verses of the Qur'aan that indicate the obligation of releasing the prisoners. It has also been narrated from the Messenger of Allah (SAW) that he ransomed the prisoners and ordered others to do so as well. This has also been course taken by the Muslims and their consensus that it is incumbent to free the prisoners by taking money from the Islamic Treasury, and if that is not possible, then it becomes compulsory as a collective duty (fard kifaayah): if one person executes it, the sin is lifted from the shoulders of the rest of the Muslims.
Imaam Ibn Juzai Al-Maaliki said:
It is necessary to rescue the Muslim prisoners from the hands of the disbelievers by fighting them. If the Muslims are unable to do so, then it becomes compulsory upon them to pay the ransom money. It is incumbent on a rich person to ransom himself and on the Imaam (leader), to pay the ransom money for the poor people, from the Islamic Treasury. If they still fall short, then it becomes compulsory to take from the wealth of all the Muslims, even if it finishes their wealth.

Imaam Al-'Izz bin Abdus-Salaam said:
Rescuing the Muslim prisoners from the hands of the disbelievers is one of the best means of coming close to Allah. Some of the scholars have said: "If even one Muslim is captured, it becomes compulsory upon us to persevere in fighting the disbelieving enemy until we either free the Muslim captives or destroy the disbelieving enemy. Therefore, what do you say if they capture a large number of Muslims?!"

Imaam Ibn Al-'Arabi said:
Unless the prisoners are from the weak and oppressed, then the State should be steadfast in their cause. To help them with our bodies is waajib (obligatory) and no one should remain behind until they all leave to rescue them or spend all of their wealth to rescue them. This was said by Imaam Maalik and all of the scholars. Verily, to Allah we belong and to Him we must return, if we leave our brothers in the hands of the enemy and they have wealth, weapons, number, strength and authority.

Imaam Ibn Hajar Al-Haithami said:
If the enemy captures a single Muslim, it becomes waajib (obligatory) on every one who has the ability, to rush to their rescue (even without seeking anyone's permission). It is apparent that it is compulsory on everyone, similar to the situation where the enemy invades our land. Moreover, saving our brothers is of a higher priority, as the sanctity of a Muslim is greater (than the sanctity of a State).

Imaam Abu Bakr Al-Jassaas said:
The ransoming of Muslim prisoners is one of the obligatory deeds that has been established upon us. Al-Hajjaaj bin Artaah narrated about this ruling from his grandfather, that the Messenger of Allah (SAW) wrote a letter to the Muhaajireen and Ansaar, to detain the enemy prisoners in their stronghold, ransom their prisoners for something befitting and for peacemaking amongst the Muslims. Mansoor narrated from Shaqeeq bin Salamah from Abu Moosaa Al-Ash'ari that the Messenger of Allah (SAW) said: "Feed the hungry, spread the greeting (salaam), visit the sick and free the prisoner."
These two serve as evidences for freeing the prisoners because the word, 'Al-'Aani' in Arabic refers to the prisoner. 'Imraan bin Husain and Salamah bin Al-Akwa' narrated that the Messenger of Allah (SAW) ransomed pagans for Muslim prisoners.

Imaam Al-Haafiz Ibn Hajar Al-'Asqalaani said:
The saying of Imaam Al-Bukhaari, 'The Chapter on Freeing Prisoners', refers to freeing them from the hands of the enemy by money or by other means. The word 'Al-Fakaak', where the faa' (Arabic letter) from the word has a fatha (it is also permissible for it to take a kasrah), means to free. This word is mentioned in two hadeeths. The first one is the hadeeth of Abu Moosaa: "Free the prisoner." Ibn Battaal said that freeing the prisoners is compulsory on a collective duty (fard kifaayah). This opinion is also held by the majority of the scholars.

 Imam Malik said: "It is obligatory on the people to redeem prisoners with their money. There is no contention on this point".

Seifullah Chapman - CMU Prisoner

We are kept in our cells so we are not permitted to participate in prison programs. We cannot go to Education, Recreation, or worse, we have no access the Chapel. We are not permitted to go to jumu'ah prayers. We cannot have Islamic classes. We cannot go to the Chapel and use the Islamic books that are in the library there or watch the Islamic videos. Access to our First Amendment right in the U.S. Constitution, freedom of religion, has been restricted to a Qur'an and a single book in the cell. Alhamdulillah, we are only two in the cell so I should not have to worry about being put on a bus for disciplinary transfer for praying in a group of three. Allah is the Greatest!

Shaykh 'Umar 'Abd ar-Rahman - Our beloved Scholar

Sheikh Omar has been imprisoned for 18 years, in which time his family have received permission to see him only once, despite numerous applications. There only form of contact is monthly phone calls that last twenty minutes.

The family of Sheikh Omar have released the following statement:

"I urge the Muslims all over the world to move on this issue. Where are you oh Muslims? A great Sheikh of this generation is suffering whilst being in the heart of America, and the world ignores him. Where is the dignity of the Muslims? Obama promises change and change with its relationship towards the Muslim world. Where is this change? Prove this change with the release of the Sheikh who is innocent of all that he's been accused of."

We went on lock-down mode again today…nothing would complete a 3 week break like another lock-down. Same usual routine follows; stay in your cell, phones, yards, showers, visits, etc… all privileges are gone… until the whole jail is searched. It used to be annoying early on, but after so long with the same routines, it makes no difference, just a temporary inconvenience. Thing's haven't been working out too well for me lately…the inoperable procedures strike again… I'm waiting to get some meds from the nurse for the past week, because they don't know how to respond to a mistake from their side, and the procedures are too fool-proof apparently, of coarse no one listens to the guy in orange because…he's the guy in orange.

Tariq Mehanna - Abu Sabaya

Each cell is basically the size of a small bathroom. In fact imagine your bathroom with a metal toilet, the sink shrunk down and connected to the toilet as a single unit, a metal desk sticking out of the wall, a metal door, a small metal bed sticking out of the opposite wall, and the walls all painted a pale cream color. That is what the cell looks like. There is a narrow window in here, although it doesn't let in sunlight due to the fact that it faces a gray wall. I do most of everything inside the cell: pray, read, sleep, etc. It is indeed a lovely little abode.

Aafia Siddiqui - Our Sister in captivity

They brought sister Aafia out in front of the judge, subhanAllah she was sinking in her seat which looked like it was due to malnutrition. Physically, she looked very weak and small. Even with this condition, she veiled herself with a white fabric and also made a niqab out of it...

The whole time judge Berman was speaking, she kept shaking her head 'no'. She wrote on a paper, "No". She spoke out and said I don't want the appointed council, how can you allow me to appoint when you keep me locked up like this all the time. Judge Berman kept telling her to be quiet and speak through her attorneys. Our sister, Aafia kept saying "I refuse to participate in this. I want to talk directly with the prosecutor and agents so that I can resolve this, make peace. The torture you put me through, I am half senile, how can I choose a lawyer when I am always in my cell."

We are also not allowed to take our prayer mats out to exercise, and there is nowhere for us to pray, e.g. a prayer room or area. Just two days ago one of the brothers asked if they can be permitted association for Ramadan, and it was refused. Normally association in other prisons is every day.

Dear brothers and sisters we are still fighting for our rights to be treated as human beings and as muslims, for the prison to have respect for our deen and our dignity. We are in the worst of the country in terms of the Italian government policy against muslims, and we are in the first line for their anti muslim agenda. May Allah(swt) give us the strength to continue in his path.

Dear brothers and sisters, whenever we even start the adhan for prayer, the guards turn the tv up full volume and laugh to disturb us. They behave in a nasty and threatening manner towards us in an extremely bad way.

Al-Tirmidhi HadithHadith 2482 Narrated by AbuHurayrah  (May Allah be pleased with him)
Allah's Messenger (peace be upon him) used to say, " O Allah, grant me benefit in what Thou hast taught me, teach me what will benefit me, and increase my knowledge. Praise be to Allah in all circumstances. I seek refuge in Allah from the state of those who go to Hell."
Tirmidhi and Ibn Majah transmitted it, Tirmidhi saying this is a tradition whose isnad is gharib.
 
Transliteration:an Abi Hurairah (radiya Allahu anhu) qaal:
qaala Rasul Allah (salla Allahu alayhi wa sallam): "Allahumma infa'ni bima 'allamtani, wa allimni maa yanfa'oni wa zidni 'ilman, alhamdulillahi alaa kolli haal, wa a'odtho billahi min haali ahlil naar."
